This website https://www.fantasygbl.com and all websites and sub-pages linked to it, hereinafter collectively referred to as the “Website”, are provided by the Hellenic Basketball Clubs Association, E.S.A.K.E. (Hellenic Basketball Clubs Association), operating under the trade name GBL (Greek Basketball League), (Vat Number: 090055775) having its registered office at Kleisthenous 338,15344, Gerakas, Athens, Greece, tel. +30 210 7565503, hereinafter referred to as “ESAKE”.

The online gaming available at the address https://www.fantasygbl.com (the “Website”) or within the “Fantasy GBL” Application, available on Google Play and Apple Store platforms, provided to Users, as defined below, by Fantaking Interactive S.r.l. (hereinafter “Fantaking Interactive”), with registered office in Corsica 14/A, 25125, Brescia (BS) VAT n. 03549330987, email address info@fantaking.it, is governed by the current general terms and conditions (hereinafter “Terms and Conditions”).

For the purposes of operating the Fantasy GBL Service, Fantaking Interactive S.r.l. acts as a data processor on behalf of the GBL as data controller, to the extent specified in the applicable data processing arrangements, and processes personal data in accordance with the documented instructions of the controller. Further information regarding the identity of the controller, the purposes and legal bases of processing, categories of personal data, recipients, retention periods and data subjects’ rights is provided in the Privacy Policy.

By using this Website, you agree to be bound by these Terms of Use, as in force from time to time. The Terms of Use may be amended periodically.

Your continued use of the Website following any changes to the Terms of Use constitutes your acceptance of such changes. Any element of the Website may be modified, supplemented, removed or updated without prior notice, at the sole discretion of ESAKE.

Access to and use of this Website is at your own risk, and you are responsible for complying with the applicable legislation and the rules governing the use of this Website.

You are advised to read the “Privacy Policy” and the “Cookie Policy”, which constitute an integral and inseparable part of these Terms of Use.

2. Definitions

The terms and phrases listed below shall have the meaning indicated below, the terms defined in singular form are also defined in plural and vice versa.

• "Application": shall mean the “Fantasy GBL” application available on the Apple Store and Google Play platforms;
• "Game": shall mean the interactive activity offered on the Site to Registered Users consisting of the possibility to participate online in the virtual simulation called “Fantasy GBL” according to each Regulation (as hereafter defined) available on the same Site (and to perform all related activities);
• "Participant" shall mean the User who takes part in the Game following the Registration;
• "Registration": shall mean the procedure envisaged for the creation of the account within the Website;
• "Regulation": shall mean each Regulation, present on the Site, which governs the rules of each individual Game, as defined above;
• "Service": shall mean the online gaming service provided by Fantaking Interactive through the Website and/or the Application, including access to the Game and related functionalities.
• "Service Provider": shall mean the company Fantaking Interactive;
• "User": shall means the natural person who, upon correct and truthful registration of his Data and acceptance of these Terms of Service, benefits from the Service;

3. Registration and conclusion

By registering in the Website https://www.fantasygbl.comas well as within the relevant Application, the User accepts the current Terms and Conditions. The User undertakes to fill in the registration form available online at https://www.fantasygbl.com and accepts the current Terms and Conditions by placing a flag in the appropriate checkbox as well as in the related information to data subject. This form must be filled correctly, completing the fields indicated, accurately and truthfully. Upon the receipt of the aforementioned registration form, the User will receive a confirmation email

By registering, the User can access the online game (hereinafter the “Game”):

The rules of each game can be found in the Regulation, as defined in paragraph 2 of this document.

The inaccurate, incomplete or non-disclosure of data could result in the failure or partial provision of services offered by GBL.

4. Object

The Service allows Users to create a personal account with which to participate in the Game as governed by each Regulation. These Terms and Conditions have as their object the access to the Game, with the faculty, for the Users, to access the area of registration teams according to the methods indicated in the Rules.

The User may use the Service through the use of an internet browser and its connection to the data transmission network without the need to install specific programs.

5. Access and use of the service

The User will be responsible for any expenses, including the internet connection, which he will support to access the Service. Limitations to the use of the Service:

• The User assumes full responsibility for any improper use of the Service by minors;
• GBL and Fantaking Interactive is not responsible for any accounts created using a false identity or false information, or on behalf of someone other than the User;
• The User must use the Service only for non-commercial purposes.

The registration requires the insertion of User data that will be processed in accordance with the Privacy Policy. At the time of the registration, the User must provide an Email and a Password. The user has the right to change the password. The User acknowledges that Email and Password constitute the validation system of the User's access to the Service and which constitute the only means suitable for legitimizing the User to access the Service. The User therefore agrees and acknowledges that all the acts performed through the use of Email and Password attributed to it will have binding force towards it. The User can update the personal data provided during the Registration so that these are constantly updated, complete and truthful. The User acknowledges and agrees that, in the case in which, in the registration, inaccurate, untrue and / or incomplete data are entered, GBL and Fantaking Interactive may find it impossible to execute the Service. In any case, GBL and Fantaking Interactive reserves the right not to activate and / or deactivate the Service without notice until the User corrects the data entered.

The User assumes all responsibility towards GBL and Fantaking Interactive or third parties for acts performed through Email and Password attributed to it. The User is required to keep Email and Password in the strictest confidence and to keep the same with the utmost diligence.

By signing the current Terms and Conditions the User agrees to be responsible for all content published or transmitted in any way through the Service. GBL and its processors assumes no responsibility for the conduct of any User, nor is it obliged to monitor the contents uploaded by them. The information provided through the Game may be disseminated (i) in the event that GBL and its processors is required to disclose information by order of the Judicial Authority, (ii) to comply with any applicable law or regulation, and (iii) in order to protect controller Interactive rights.

The User acknowledges and accepts that the Data provided and related to the use of the Service will be used and stored by GBL and its processors in a special database protected in compliance and in respect of the D .lgs. n.196 / 2003 (the Italian “Privacy Code”) and of the General Data Protection Regulation 679/2016 and any applicable law.

You are advised to read the “Privacy Policy” and the “Cookie Policy”, which constitute an integral and inseparable part of these Terms of Use.

6. Security of credentials

The User will be provided with access credentials related to his Account. The credentials, to be considered personal, must be kept by the User, who will be required to adopt appropriate security measures aimed at keeping them. In case of loss and / or theft of the credentials, the User undertakes to contact as soon as possible Fantaking Interactive that will not be held responsible for what happened during the period between the theft / loss and the aforementioned communication.

7. License - Intellectual Property

The Site, as well as everything contained therein, is protected by Laws on intellectual and industrial property. The contents, the materials, the works published or otherwise present on the Site - including, but not limited to, trademarks, images, catalogs, sounds, photographs, databases, press releases printing and documents generally reproduced, as well as the application software, html codes - are the exclusive property of Fantaking Interactive S.r.l, or used with the authorization or license of the relevant rights holder, or in a descriptive sense and in compliance with applicable law; the user may dispose of it only if such activity is strictly necessary for the proper use of the Site and cannot, therefore, freely use them. Fantaking Interactive reserves all the rights, including the right of reproduction.

8. Game

The User undertakes to respect the following rules:

• By accessing and participating the Game, the Participant agrees to accept to participate in the Game in compliance with the Terms and Conditions, the Regulations and any other material relating to the Game published on the Website;
• Any request to participate in the Game must be made by a natural person (the “Participant” or the “Participants”) by means of the electronic form for registration on the Site. The access and the participation are free;
• GBL and Fantaking Interactive reserves the right to refuse the acceptance of names indicated in the registration form if considered, at the sole discretion of the same, inappropriate or offensive. The unsuitable names will be deleted, and the User will be assigned a name arbitrarily chosen by GBL and Fantaking Interactive.
• To the extent permitted by applicable law and in accordance with the Privacy Policy, by registering you have been informed for the the use by GBL and Fantaking Interactive and any third party authorized by Controller and you will be asked to consent to the use by GBL and Fantaking Interactive and any third party authorized by Controller of the User's names and photographs. In particular, GBL and its processor intend to publish the name of the winner and, if available, a photo of the winner on the Website, on the Instagram page https://www.instagram.com/greek_basketball_league/?hl=el. By participating in the Game, each Participant undertakes to read the Privacy Policy and, in case of victory, if requested by GBL and it processor Fantaking Interactive, publish their name and, if available, a photo;
• The information material relating to the Game (including the instructions for this competition and for the points awarding system) and the Regulations form part of these Terms and Conditions;
• GBL and Fantaking Interactive may, in its sole discretion, suspend a User, cancel any registration or modify the Regulations and/or Terms and Conditions of Service at any time or cancel the Game at any time in the event of circumstances beyond the control of GBL . or that make such action necessary and emergency (fraud, technical failure, force majeure, security incident, legal/regulatory requirement.
• Participants accept that GBL is not responsible for the consequences thereof and that the exercise of such discretionary power does not give rise to any consideration payable to any Participant or other person;
• GBL and Fantaking Interactive reserves the right to make any decision regarding any matter relating to the Game.

Unless otherwise expressly stated, the material available on the Site must be used exclusively for information purposes. GBL does not guarantee that the material available on the Website is appropriate or available for use in jurisdictions other than the Greek one. Participants who choose to access the Site from other locations do so at their own risk and are responsible for complying with local laws and regulations.

8.b. Cheating, Bots, Manipulation and Prohibited Conduct

Users may not engage in any conduct intended to obtain an unfair advantage, interfere with the proper operation or integrity of the Game, or manipulate gameplay, scores, rankings, results or prizes. Without limitation, prohibited conduct includes the use of bots, scripts, macros or other automated tools; automated access to or interaction with the Game, its systems, APIs or services; scraping, data extraction or unauthorised collection of Game data; exploiting bugs, vulnerabilities, glitches or errors; manipulating scores, rankings, results or other Game data; creating or operating multiple accounts where prohibited by the applicable Game rules; collusion or coordinated activity intended to obtain an unfair advantage; sharing, transferring or allowing third parties to access or use an account; fraudulent, deceptive or abusive activity; and any attempt to interfere with, disrupt, overload or circumvent the security or technical operation of the Game, its servers, APIs or related systems. GBL may investigate suspected violations of this Section and, where it reasonably determines that a violation has occurred or is reasonably suspected, may take appropriate action, including restricting or suspending access to the Game or an account, disqualifying a User or entry, cancelling or adjusting affected scores, rankings or results, and, where permitted by applicable law, withholding or cancelling any prize, reward or other benefit. GBL may also take such action where necessary to protect the integrity, security or fair operation of the Game, subject always to applicable law and any specific procedures or rights expressly provided under these Terms.

9. Awards

The game provides prizes for the winners of the Matchday and super final prizes for the users who, at the end of the season of regular season or Playoffs, will be in the top positions in the standings. The modalities of the participation in the competition are indicated in the appropriate Regulations available on the website.

9a.1 WINNER NOTIFICATION AND AWARD OF PRIZES

9a.1 Governing rules. The conditions for participating in each game, the determination of winners and the nature and value of each gift, prize or award (monetary or otherwise) are set out in the official game rules published on the Platform for that game (the "Game Rules"). These Terms of Use apply in addition to the Game Rules. In case of conflict regarding a specific game, the Game Rules shall prevail.

9a.2 Contacting the winner. Once a User has been determined to be a winner in accordance with the Game Rules, the Data Controller will contact the User using the contact details provided by the User on the Platform (name and e-mail address), in order to notify the User of the award and to explain the steps required to receive the gift, prize or award. Users are responsible for ensuring that the contact details they provide are accurate, complete and up to date, and that they regularly check their e-mail inbox, including spam or junk folders.

9a.3 Identity verification and payment. Where the Game Rules provide for a monetary prize, or where otherwise required for the award, the User will be asked to consent to the transmission of their details to SNAPPI BANK S.A. (the "Bank"), for the purposes of verifying the identity of the winner and of awarding the prize. Monetary prizes are paid exclusively by the Bank, by bank transfer, to an account that the User must hold with the Bank, and by no other means. If the User does not give this consent, or does not hold or open such an account, the prize cannot be awarded in this manner, and the consequences set out in the Game Rules shall apply.

9a.4 Time limits. The User must respond to the Data Controller's communication, and provide the information or documents requested, within the time limit stated in the Game Rules or in the notification. If the User fails to respond within that time limit, or cannot be identified or reached, the Data Controller may treat the prize as forfeited and may award it in accordance with the Game Rules.

9a.5 Minor Users. If the winner is a minor, the gift, prize or award will be awarded exclusively to the minor's legal guardian(s). The legal guardian(s) must contact the Data Controller on behalf of the minor and provide their own personal data (name, e-mail address) and those of the minor User, for the purposes of identification and of awarding the gift, prize or award.

9a.6 Authenticity of communications. The Data Controller will contact winners only through the channels described in this clause and the Game Rules. The Data Controller will never ask Users to disclose passwords or to pay any fee in order to receive a prize. Users should disregard and report to the Data Controller any suspicious communication claiming to relate to a prize.

9a.7 Personal data. The processing of personal data in connection with the award of gifts, prizes and awards, including the transmission of data to the Bank, is described in the Privacy Policy, available at [link]. By participating in a game, the User acknowledges having read the Privacy Policy. The Privacy Policy forms part of, and should be read together with, these Terms of Use.

10. Guarantees

Any compensation for damages due or related to the non-provision or suspension of the Service is excluded, unless the negligence or bad faith of GBL is proven in the performance of its obligations.

The Service Provider undertakes for the entire period of validity of the Service Conditions to put into effect what is available in order to guarantee the functionality of the Service, taking into account the reduced level of responsibility in performance due to the free nature of the relationship. In this regard, the User acknowledges and recognizes that during the term of these Conditions of Services there may be interruptions also for maintenance and / or technical interventions which, as far as possible and except for force majeure, will in any case be communicated to the User.

The User undertakes not to use in the use of the Service expressions contrary to public order, morality and morality and also undertakes to immediately report to the Service Provider the presence of messages or communications in violation of such fees from other users. The User also undertakes not to injure, prejudice or otherwise violate the trademarks, logos, intellectual and industrial property rights and any other tangible or intangible goods of the Service Provider.

In particular, GBL disclaims any liability and does not guarantee that:

• the Site and the services available on the Site will satisfy the User's needs
• the services and functionalities available on the Website will be uninterrupted, well-timed, secure or error-free;
• the results that could be obtained from the use of the Website and the services on the Website will be accurate and reliable;
• the defects will be corrected;
• the Site or the servers that make it accessible will be free of viruses or other harmful elements.

The material downloaded or obtained in any other way through the use of the services will be at the sole and exclusive discretion and only and exclusively risk of the User, who will be solely responsible for any damage or loss of data eventually caused to his computer in consequence of downloading this material.

The User agrees to hold GBL unharmed and the companies charged by the latter for the execution of the Service from any complaints and requests for damages from third parties deriving from an improper use of the Service, or not compliant with these Terms and Conditions.

Nothing in these Terms shall exclude or limit any liability or consumer rights that cannot be excluded or limited under applicable law.

11. Suspension of the service

GBL and Fantaking Interactive may, at any time, interrupt the provision of the Service if there are justified reasons of security or violations of the law, also established by the competent authorities, as well as in case of conduct contrary to public morality and morality.

12. Transfer

Fantaking Interactive may substitute itself in exchange of a different subject and/or transfer and/or subcontract any obligation arising from the relationship, in whole or in part, at any time and without notice or obligation of communication to the User.

13. Communications

14. Privacy

In relation to the processing of the User's Personal Data, please refer to the information for the processing of Personal Data, available in extended form at Privacy Policy.

15. Modification of the General Conditions

GBL and Fantaking Interactive may amend these General Conditions from time to time where justified reasons exist. Any amendments shall apply to the User as of the date of their entry into force, provided that the User has been duly informed of such amendments. In any event, the version of the General Conditions published on the Site and in force at the time the Contract was concluded shall apply to the Contract, subject to any subsequent amendments duly notified to and, where required, accepted by the User.

Where the User’s consent is required for any amendment to the Terms and Conditions or the Privacy Policy, the User shall be duly informed of the proposed amendment and shall be given the opportunity to accept or reject it. If the User does not accept such amendment, the User may terminate the Contract and withdraw from the Service by deleting their personal account through the “Profile” section of their Personal Area on the Site.

In such case, the Service Provider shall, within the time reasonably necessary to process the User’s request, disable the User’s access to the Service and cease the processing of the User’s personal data, except where the continued processing of such data is required or permitted by applicable law.

16. Applicable law and disputes

The contract is governed by Italian law, without prejudice to any other prevailing mandatory rule in the country of residence of the customer. If the customer is a consumer, competent to decide on the merits is the Consumer Court. If it is not a consumer, the Court of Milan is competent to settle the dispute.
